U.S. Closes Criminal Investigation of AZ’s Sheriff Joe Arpaio, Other Legal Battles Await Him

Ann Birmingham Scheel, acting on behalf of the United States due to the recusal of U.S. Attorney John S. Leonardo, announced that her office is closing its investigation into allegations of criminal conduct by current and former members of the Maricopa County Sheriff’s Office that include Sheriff Joe Arpaio and the Maricopa County Attorney’s Office.

The abuse-of-power investigation is now closed but Arpaio still facing a civil suit by Latino advocates who believe he targets Latinos whether they are legally in the country or not.  Arpaio is also facing charges by the U.S. Department of Justice for alleged constitutional violations for racial profiling of Latinos and others with limited English language skills. 

The U.S. Attorney’s Office has advised Maricopa County Attorney Bill Montgomery of its decision not to pursue state criminal charges related to the investigation.

Ms. Scheel commended the joint investigative efforts of the prosecutors and the FBI special agents who conducted the investigation.

Arpaio, who has supported the presidential candidacy of Republican Mitt Romney, said that if the former Massachusetts governor wins the presidency in November, Congress should work with him to legislatively solve the problem of illegal immigration.
