Dear Friends, I am writing with an another update on the "childrens rights" referendum challenge. We have had a busy week with some unexpected twists and turns.....but like driving the roads where I live, we're nevertheless going forward and getting somewhere. When I wrote at the beginning of the week the case was lodged in the High Court, with a week's extension for lodging more paperwork. This challenge suspends the referendum process, eg the president can't sign the amendment into the constitution. Below are the details for those who have so generously pledged funds. The pledges have been very instrumental in launching this challenge. We welcome anymore pledges at any time. If you are making a transfer or sending a pledge please be sure that you include your name and contact details so we can get back to you (especially if eventually costs are awarded in our favour because it is a hope of mine in this eventuality to be able to return pledges). At the time of entering the challenge, we registered two petitioners. In a story to be told at a later date, we are looking for a replacement for one. So we are now actively seeking a replacement asap. The replacement needs to be an island or postal voter who either voted yes or abstained who when they, after their vote, heard about the McCrystal Judgment (that the government had broken the referendum rules and misstated an effect of the referendum) they had doubts or regrets about their vote and is willing to be a petitioner. We have a Plan B if this petitioner is not found, it will be good, but not as strong as the yes or abstaining postal or island voter..So please keep looking for one more day. And many thanks to all of you who have been out searching. Many of you have also very helpfully offered legal arguments suggestions for the challenge. These I pass on, they are all considered and some are showing up in the court documents...so well done! Please keep thinking, researching and sharing. In fact during the week, we got feedback from two legal experts (one blogging and one personal feedback) unconnected to the case that the arguments in the challenge are very clever and unexpected. Also thanks to those who have been searching the web, newspapers, etc documenting and preserving the evidence from the referendum period, before during and after. Everything is worth saving. A specific thing we are looking for right now is a full collection of the governments responses to the McCrystal Judgment, so this is anything they said or did from Thursday Nov 8th 11 a.m. to the vote on Nov 10th and anything of interest that they have said since. There are other efforts going on in tandem with the legal challenge that seek to confront and expose the level of contamination in the children's rights referendum process. These could also use help, so if anyone has any record or memory of use of the government's so called "information campaign" (that was condemned by the Supreme Court) on RTE or other stations, whether it was running an ad or showing the logo, website or booklet or repeating the front/home page bullet points these are of interest. Exact times would be great but any information at all it would helpful. Also if any young person or anyone was included in an offer of an ipod from USI or NYCI, please get in touch or if you have any information on same.. During the week someone called ths challenge "the lynchpin" and I think she is right because this challenge is about democracy itself, whether there will ever again be the possibility of a fair and free referendum in our country and in particular a fair and free referendum on the so called "childrens rights" In the next update, I will do my best to explain the case as set out to date and anything we will know then about a timeline. "someone might be able to go through all the media coverage and determine whether, at any stage, the Government ever made any reference at all to international standards for conducting referenda" or elections. If anyone has time could they do some trawling and get back to me on this, please.
