Justice officials confirm that Dzokhar Tsarnaev was not read his Miranda rights after being captured in Watertown on Friday
Controversy over the decision to deny Dzhokhar Tsarnaev his so-called Miranda rights deepened on Saturday following calls for the Boston bomb suspect to be classified as an enemy combatant.
Justice officials confirmed Saturday that the 19-year-old was not read his rights – included an entitlement to remain silent – after being cornered by police after a 22-hour manhunt in Watertown.
Massachusetts US attorney Carmen Ortiz said that “a public safety exception” applied in the case. Such an exemption would allow law enforcement agents to interrogate the suspect without warning and use any information extracted as evidence in courts.

Most people assume that when read their rights those rights are then in effect. NOT SO!
Miranda established that persons under arrest deserved a “reminder” of their Constitutional rights under the Bill of Rights. Whether they are read by a courteous arresting officer or not YOU HAVE THESE RIGHTS! They are inalienable – that is to say they cannot be separated from you having been conferred at your birth if not in fact upon conception.
Do not talk to police before, during or after an arrest. 90% of people provide probable cause in the “nice guy” discussion before they are arrested. That anyone (who in this country as a person, not even citizen) has these rights is defined in the Constitution which all public servants have sworn to uphold.
Whether they are read and reminded of these rights is immaterial – except for the ACT which REQUIRES them to be read – when ignored – is commonly reason to throw the case out for violation of the Miranda Warning Act. All discussion is irrelevant – Lindsey Graham and such TREASONIST opinions aside.
This is our rule of law that makes this country worth living in unlike anywhere else in the world. Even if these boys are guilty as hell, they (other than one being murdered) they could WALK on this reason alone.
Our legal procedures protect the innocent, the guilty and society at large. Ironic that in Boston – the fountain from which these protections originally sprang against the British – may be where they are lost again.
