Update 20 Referendum Challenge

Dear Friends,

The Plenary (Constitutional) case has begun. Arguments are being heard on next Tuesday 10th  and Wednesday 11th December. The case will be put forth from Jordan (our) side that sections of the Referendum Act (or their current interpretation) are unconstitutional because they requires a citizen to do what is virtually impossible to defend one of its most important sovereign rights, the right to free and fair referenda. We are saying that if we have a right we must have a way of defending that right or it is no right at all.
This stage of the referendum challenge really brings home the importance of this whole effort.  To loose  means that in future the government can do whatever it takes to win a referendum and there will be nothing anyone can do about it. To win means that we the people of Ireland can defend our right to fair referenda in the future starting with the Childrens Rights referendum which would then have to be rerun without illegal interference.
Everyone is welcome to attend the High Court on Tuesday and Wednesday. It promises to be very interesting.
In relation to the Referendum Petition, there were two more days in court since I last updated you. They were primarily on the issue of costs which in this case has critical significance for our sovereignty because it is about the ability of ordinary citizens to hold government to account. Remember not only did the government illegally spend taxpayers funds to tamper with the Childrens Rights referendum, but it then used taxpayers funds to defend their tampering against Mark McCrystal. And even after their tampering was confirmed and condemned by the Supreme Court in the McCrystal Judgment, it is using taxpayer funds in the Jordan Challenge to ensure that illegal government interference even if condemned is consequence free.
I was not in attendance either day that this was under consideration so the following is Johanna Jordan’s account.
“Day 23
8th November 2013 held in  High Court room 13 in the Dublin Four Courts. Judge Paul McDermott presiding. Paul Sreenan S.C. representing us. Michael Collins S.C. for the Dept. of Children….. High Court Costs arguments. The State are not looking for their costs to be paid by us. They are paid by the Dept. of Children. Case histories were put forward where Petitioners who lost cases were awarded costs.The point was also made that I was taking this case out of public interest only. The court order awarding costs in the Hanafin case (this was the only other referendum challenge) could not be found.
Day 24
22nd November 2013, held in High Court room 24 in the Dublin Four Courts. 15 minutes before the Court was due to start  the court order awarding costs to Hanafin was found. Copies were given to both sides and to Judge McDermott. there was some discussions about it from both sides. Then the Judge suddenly left the court for 10 minutes. He came back (with possibly an amended judgement).He read out his entire judgement. He conceded that I acted in “good faith”. He awarded 1/3 costs to us. The state asked for time to consider taking an appeal against the judgement. The Judge gave them two weeks,  We also need to decide  if we will appeal it. 1/3 will not cover our expenses.”
Defending the Indefensible with our money!
Follow the money! The government is fully funded by the tax payer throughout this challenge but wants to ensure that the petitioner/citizen challenger does not get costs…why? Could it be because they want to ensure that there will never be another referendum challenge. Governments have been illegally interfering with many  referenda since the Hanafin Challenge failed in the mid 1990. I have attach a study of this below. They may have thought that they were untouchable and that there never would be another referenda challenge. ..and they might have been right if they hadn’t crossed the line by breaking the law to  establish State control of children and childhood. Irish people long suffering but we have our limits!
