Salinas v. Texas does not apply if not under arrest; rather, when just being questioned, our silence CAN be used against us.
If questioned, instead of remaining silent, perhaps say this: “Officer, in good conscious, and under the advice of counsel, I am unable to answer your questions; however, if you would write down your questions and mail the signed list of questions with your name and badge number, I will consider your questions appropriately.” (The questions can show what angle the cops are taking, we remain in honor by not remaining silent by conditionally accepting their offer, and silence will not be available to be used against us.)
Just suggestion, not a lawyer or anything. Talk amongst yourselves.
