“Requesting such an opinion from the occupying power seems pre–‐ordained to receive a negative response. The United States appears to have no problem with continued occupation over decades, even after the passage of the Apology Resolution admitted that the occupation is based on the illegal overthrow.
“The concerns expressed by Kamana’oppono have a legitimate foundation. The source is the actions of OHA in seeking to establish a semi–‐independent Hawaiian governing authority that would still be subservient to the United States – the so–‐called nation within a nation. Under Kingdom law, a group within the nation trying to extinguish the independence of the nation would be guilty of treason. Queen Liliu’okalani faced that very question and ultimately agreed not to prosecute those who seized the Kingdom government in return for restoration of her crown, an agreement that the United States never fulfilled.
“By seeking to extinguish the Kingdom, OHA is engaging in the next phase of the overthrow. That such a pursuit might ultimately lead to criminal charges against the Trustees and employees of OHA is precisely why Kamana’opono wrote his letter.
“For all of the above reasons and meaning no disrespect, the opinion of the United States Department of State on the existence of the Kingdom is irrelevant to the Kingdom.
“The time has come for the United States to acknowledge the right of the Kingdom to be restored like any other occupied nation and to stop trying to subvert that end by entertaining half–‐baked plans to create a subordinate nation.”
