It was only a mater of time before the next attempt at curtailing 2nd Amendment Rights surfaced on Capitol Hill. A little over a week ago, Senator Barbara Boxer introduced “The Pause for Safety Act.” As is typical with controversial legislation, “framing” and public relations considerations envelope proposed law — including the names of bills.
According to a press release on Boxer’s website, the proposed legislation will include the following provisions:
• One, it would help ensure that families and others can go to court and seek a gun violence prevention order to temporarily stop someone close to them who poses a danger to themselves or others from purchasing a firearm.
• Two, it would help ensure that families and others can also seek a gun violence prevention warrant that would allow law enforcement to take temporary possession of firearms that have already been purchased if a court determines that the individual poses a threat to themselves or others.
• Three, it would help ensure that law enforcement makes full use of all existing gun registries when assessing a tip, warning or request from a concerned family member or other close associate.
As with most laws and regulations targeting firearms, the stated goals of “gun control” usually are totally unable to stop bad people from committing crime with guns. Boxer’s proposed legislation will not stop a determined perpetrator from obtaining a firearm on the black market, and firearms are not the primary weapon used in most cases of domestic violence. But one thing is certain to happen should this proposed legislation become law: innocent gun owners will find themselves targets in a system that is increasingly set-up to be reactionary, and structurally set-up for abuses of due process. Restraining orders, while not perfect, remain the standard and most effective law enforcement tool applicable in domestic violence cases. A restraining order actually focuses on the problem.
It should also be pointed out that this legislation represents a subtle effort to further legalize what is already taking place outside of law: Federal agencies accessing and maintaining firearms registries.
