Five million immigrants in the US will sleep more peacefully tonight. Them and their families will not be held accountable for violating US laws. President Barack Obama announced tonight the ‘regularization’ of illegal immigrants in the United States. The measures will enable beneficiaries to avoid deportation, access to a work permit and more importantly, access to government welfare.. The measures, which Obama adopted without congressional support, and in clear violation of the US constitution, open a battle over the limits of presidential power and the multi-ethnic future of the United States. Despite the fact fervent supporters of illegal immigration see Obama’s move as a moral, fair and just action, reality says otherwise. The Democrat in the White House attempted to justify his overreach of power to Americans tonight in prime time. He spoke of a series of measures that, together with so called ‘health care reform’ may be the most important part of his political legacy when he leaves the White House in 2017. “If you meet the criteria, you can emerge from the shadows and be protected by law. If you are a criminal, you can be deported. A lot is said in this statement. First, in Obama’s world, illegal immigrants who violated US immigration law are not criminals. Obama seems to have used his pardon powers to give millions of illegals a clean sheet. If you enter the US illegally, you have increased the chances of being caught and sent back,” Obama said in his speech tonight. Of the five million undocumented immigrants -most from Latin American origin- only criminals and gang members will not benefit from Obama’s plan. Instead, Obama said, parents of five million illegals will also be allowed to enter the US. In total, at least 30 million people will get into the US. These people are not an unusual case in this country where any child on US soil is automatically a US citizen, even if his parents are undocumented illegal aliens. According to Obama’s plan, the measures also benefit those who entered the US illegally before the age of 16 and who live ‘perfectly integrated’ to regularize their status. A similar measure passed in 2012 and allowed the regularization of about 600,000 young people, who are now called dreamers. At least for now, the measure does not grant beneficiaries a permanent residence permit, which would open the door to citizenship. Different from a law passed by Congress, Obama’s executive action is not the law of the land, so any future president may revoke it. That is an unlikely outcome, however, considering that no president will take it upon himself or herself to carry the political burden of deporting 30 million people after Obama legalized them. The White House has called Obama’s executive actions justified as a response to the inaction from Congress, where the GOP has blocked previous attempts to unconstitutionally legalize US immigration law violators. The law that Congress debated opened the door to permanent residency and citizenship for many of the more than 11 million undocumented immigrants living in the US. With these measures, there will still be more than six million who remain in the legal shadows, which is why Obama’s overreach of power does not really fix the immigration system. In fact, it only makes it worse as millions of people will see his actions as a possibility to come to the US seeking a permissible government that receives them with open arms. It is also important to remember that under Obama’s orders deportation is no longer a priority for the authorities. The priority, according to Obama is dealing with those responsible for serious crimes and those who have arrived in recent months. Will Obama be deported himself? The arrival of hundreds of thousands of Central American children in the first half of this year sounded the alarms as the Obama administration unilaterally decided to allow them to come into the country. Perhaps the only aspect of Obama’s plan that makes sense is to provide foreign students in scientific and technological careers to stay in this country after the completion of their studies. Large companies in Silicon Valley have complained about the lack of skilled professionals in the technology sector. The provisional regularization process will begin in the coming months. The last major legalization of illegal immigrants was the result of a law signed by Republican Ronald Reagan in 1986. Another Republican, George W. Bush tried to get Congress to adopt an ambitious immigration law, but ran into opposition from lawmakers from his own party. The debate now focuses less on the content of the reform and more on the method. Few in Washington argue that current laws do work, but many understand that Obama’s actions are indeed unconstitutional. The Republican Party, bolstered by victory in the legislative elections of November 4, accuses Obama of provoking a constitutional crisis by unilaterally adopting a reform of such kind. “The actions I am taking are not only legal, but are measures such as those adopted by Republican presidents and Democratic presidents over the past half century,” Obama replied. In the United States it is clear now, more than ever, that violating the law is not illegal when the president does it. More news from The Real Agenda:
