The original murder indictment against David Carlson in the Oct. 11, 2013, fatal shooting of Norris Acosta Sanchez was tossed in late 2014 because of a flawed grand jury presentation.
Carlson, 43, of the Town of Deerpark hamlet of Sparrowbush, was indicted Thursday on three counts: second-degree murder, first-degree manslaughter and second-degree manslaughter. The charges represent three legal theories of his state of mind at the time of the shooting: intending to kill, intending to cause serious harm, and recklessly causing harm.
