Hungary Makes it Illegal for Migrants to Cross its Borders

Hungary announced this morning that it has opened a criminal case against 60 migrants for breaking the fence separating the country with Serbia, reports the news agency AFP. Hungary sealed yesterday its border to refugees and only processed requests for asylum in areas of conflict and for people with documentation on the official entry points, while today the country approved legislation that contains penalties of three years in prison for illegal entry to the country.

Lawyers consulted by the Hungarian public television M1 have ensured that the first sentences for summary proceedings, will be only conditional and will result in the expulsion of the country. Should a person attempt to enter again, the prison sentence will be effective immediately. A total of 130 judges will apply the new rules through a speedy trial in the southern city of Szeged. From now a new process of accelerated asylum procedures will determine whether applications are accepted or not, and it will also establish whether refugees who do not obtain that status will be returned to Serbia.

“We have to do it that way, since it is the international legal norm,” said the spokesman for the Hungarian government, Zoltán Kovács, who added that “a new era begins with this law and with the physical closure of the border” at the crossing of Röszke. Meanwhile, the Hungarian government has built a 175 kilometer fence on its southern border with Serbia to curb the influx of refugees and has deployed some 900 police and 4,300 soldiers in the region. The Cabinet will consider declaring a state of emergency today by the “mass migration”, which would facilitate the State to take extraordinary measures to contain the migratory wave.

On Monday, the Hungarian police detained 9,380 migrants who crossed into the country from Serbia, the highest in a single day so far this year, as confirmed by local law enforcement. Late yesterday, the police even blocked the main border crossing at Röszke used by migrants, mostly Syrians, in their attempt to advance into northern Europe. So far this year the Hungarian authorities have registered more than 180,000 refugees who entered the country illegally, although the vast majority continued their way into Germany, Holland and the Scandinavian nations.

The treatment of refugees has been harshly criticized by organizations like Human Rights Watch (HRW), which have asserted that conditions in the shelters are “inhuman”. Serbia has warned it will not accept Hungarian refugees who try to return “by force.” “We will not stop anyone by force on our territory and thus will not allow any country to return anyone by force to our territory,” said Serbian Minister of Labor, Aleksandar Vulin. “The refugees are in Hungary and we hope that the Hungarian State treats them properly,” added Vulin. The minister pointed out that refugees who fail in their attempt to enter Hungary may remain in Serbia and return to the shelters.
