A new Congressional Research Service (CRS) memo obtained by Breitbart Newsreveals that, as a result of President Obama’s controversial executive amnesty, illegal aliens who were able to get a Social Security number and a work permit may be able to file amended returns with the IRS.
Breitbart News further noted:
The report comes following the Internal Revenue Service’s confirmation that once illegal immigrants are granted Social Security Numbers – as a result of Obama’s executive actions – they will be able to file back tax returns and obtain up to four years of tax benefits, including the Earned Income Tax Credit (EITC) and the Child Tax Credit (CTC).
In a separate report, The Associated Press
said illegals “will now be able to claim up to four years’ worth of tax credits designed to benefit the working poor. For big families, that’s a maximum of nearly $24,000, as long as they can document their earnings during those years.”However, Breitbart News said that the CRS report, which was requested to measure the amount of tax benefits amnesty relief could potentially generate, examined the amount of EITC and CTC for a hypothetical family from 2011-2014.
That could mean much more than $24,000 in illicit returns.
The CRS study figured the maximum level of
tax credits that were available to hypothetical families with three and four children. The non-partisan research service found that for a family with three kids in the four years spanning the aforementioned timeframe the “phase-out threshold amount” would be in $35,521 in the EITC and CTC. For a family with four kids, that figure rose to $35,650.“In those years considered, the “phase-out threshold amount” for both hypothetical families was $21,770 in 2011, $22,300 in 2012, $22,870 in 2013, and $23,260 in 2014. Both hypothetical families were also able to amass around $9,000 worth of the EITC and CTC annually in the years CRS considered,” Breitbart News reported.
Republicans in Congress are calling the benefit an “amnesty bonus.”
Backers of the payments say the illegal immigrants are owed because they pay taxes. Stephen Goss, Social Security’s chief actuary, said illegals contribute about $100 billion a year in Social Security payroll
taxes.But the refunds they would be getting are based on income tax credits, and those working and living in the country illegally don’t file income taxes.
No matter; the head of the IRS is defending the practice.
“Section 32 of the Internal Revenue Code requires an SSN on the return, but a taxpayer claiming the EITC is not required to have an SSN before the close of the year for which the EITC is claimed,” IRS Commissioner John Koskinen wrote in a letter explaining the benefit to Sen. Charles E. Grassley, R-Iowa.
