(Before It's News)

Officers were called to a gas station in Toms River, New Jersey on Wednesday afternoon responding to calls of a man moonwalking and acting erratically while selecting items in the store. Obviously, neither moonwalking nor acting erratically are crimes, but officers decided to investigate the scene and search the man’s pockets anyway.

Mark Wixler, 39, was seen moonwalking while choosing merchandise in the Speedway Gas station. When officers searched Wixler, they found six hypodermic needles and a negligible amount of heroin.

Officers also discovered that Wixler had a $2,000 warrant in Neptune Township.

“Moonwalking is not a crime, but moonwalking with heroin and needles is,” said Community Affairs Officer Ralph J. Stocco, but he’d be wrong. Heroin is not a criminal act because there is no corpus delicti. Without a victim, whom is the crime against?

Wixler was processed in the Ocean County Jail, and his court date has not yet been announced.
