While Obamacare is moving along as planned, opponents of the law got a nice morale boost today as a judge refused to dismiss a lawsuit that challenges the IRS’ authority to issue subsidies for Obamacare. Katie Pavlich writes:
The judge will not issue an injunction to stop the IRS from issuing subsidies, meaning Obamacare can move forward as planned. However, the lawsuit will also move forward and depending on the outcome, could limit IRS power to issue Obamacare subsidies. A federal judge has refused to dismiss a lawsuit challenging the legality of Obamacare subsidies distributed by the IRS to people enrolling in the new healthcare system. The Department of Justice has argued for months the lawsuit should be dismissed.
