”All communications we provide to you by mail, electronically or otherwise shall be deemed personally delivered to you, whether you actually receive the communication or not.” The bank can claim it has mailed (or emailed) something to you and whether you got it doesn’t matter. The fact that the band says it mailed it is all that matters because you agree to all clauses in the agreement if you don’t read the fine print.
The bank doesn’t have to have any proof of mail if you say you did not receive it, like a summons you never recieved resulting in a default judgement against you.
Interesting that there is no signature page at the end of this document. This says they will probably have you sign some other document that refers to your agreement to this document.
Remember, you cannot legally sign away your common law rights, so just read any document carefully and always ask f there is anything in the documents they are asking you to sign that would infringe upon your ownership and control (common law) rights. A contract is at least a two-way street unless you voluntarily agree to a unilateral contract.
