I then preceeded to check the defamation laws of the state you are in, regarding the deceased. And whether or not the state would bring a public prosecution based upon content posted on an international, internet based commerical forum, regarding an overseas defendant. It was quite a task. There are a few grey areas that need clarification, but even at this early stage the indication is that a case could be bought against someone if they make comments that;
A Bring into question the mental health of the defendant without documented medical evidence
B Cause unnecessary distress to family and professional colleagues of the defendant
C And this an interesting one…. Bring professional disrepute to the defendants employe rs, through the implication of incompetence directed at the place of work.Phew, quite a lot to consider there with just those 3, in fact you have printed and therefore liable for over 23 examples of defamation and slander. 5 of which i believe would stand up in a court of law, 2 of which i would believe to have a 70/30 chance of a conviction. Probably resulting in financial damages being paid both to her remaining family [her children] and potentially her employees too. Ms Saldanha did not court media attention, was not a celebrity, she was a nurse who answered a telephone call. The result ended in her tragic death. We will never know what took place between the phone call and her death.

I have been looking around your site and found a lot of interesting reading.I tried to sign up [$] but the site would not let me so I started reading the conversation above. I have to say I think you both have made excellent points however the more I read the more disturbed I became . Do you not think that perhaps what started out as a debate became an ugly point scoring exercise? I would like to hear more if you both were capable of leaving your egos at the door. Please understand I am not judging, more saddened that two enlightened souls forgot who you are. There is room for both and I did enjoy the meeting of minds and do see what you were both trying to say . However when it disinergrated into name calling, threats and who would have the lat word I can’t say I quite believe you are walking in the light as often as you want to believe . I have to say I think you both have made excellent points however the more I read the more disturbed I became . Do you not think that perhaps what started out as a debate became an ugly point scoring exercise? I would like to hear more if you both were capable of leaving your egos at the door.
