Equity: Why The Government Has Hidden It From Americans

The word “equity” appears in both the 1599 Geneva Bible (you can view it at www.genevabible.org) and the U.S. Constitution, but you will be hard-pressed to find it in state statutes and federal law. Unfortunately, federal and state governments have taken great pains to disguise equity and/or to hide it from public view in their published statutes and codes. What most Americans do not know is the word’s meaning and the fact that most courts are empowered to adjudicate equity suits (based on trust relationships) today.

Let’s look at the word’s meaning first: “fairness or justice in the way people are treated” (Merriam-Webster Online). Does this sound like our statutory court system today?! Of course not. In order to be treated with equity in an American court, you must be the beneficiary of a trust (the equitable title holder of property – personal, automobiles, land, and even family members)–and your ownership rights must have been violated (or trespassed upon). You must demonstrate to the court that a trust exists (typically a one-page document articulating the relationships between the parties). The trustee(s) holds legal title while the complainant holds equitable title (which is the highest form of title). The trustee must act in accordance with his or her duties as outlined in the trust to preserve the beneficiary’s right, title, and interest in the property identified in the trust (called “res”).

Unfortunately, the state and federal governments use Americans’ ignorance of trust law to gain control of their property, including cars, land, and even their children. In a process called escheatment, for example, the state government takes custodial control of a newborn baby by initiating a certificate of live birth, from which a bond is issued that pledges the baby’s future labor throughout his/her life to pay off the national debt. From that point on, the county, state, and federal governments will address all correspondence to the person in all capital letters (“JANE FRANCIS DOE”) based on the Roman principle of “Capitis diminutio maxima,” a complete loss of freedom, citizenship, and family rights (i.e., slave or bond servant status). Without our knowledge, in other words, we became bond servants of the government as soon as our mothers signed our certificates of live birth. This could have been prevented had our fathers signed the certificate of live birth as grantee, but the hospital staff whisked away the document as soon as they secured our mothers’ signatures. (Note: in equity, the husband/father is considered to possess his wife and children.)

How can Americans remedy this fundamental injustice? Convey all family members into a family trust, making the State Registrar of Vital Records the trustee (s/he is already holding the legal title, so you only have to create a trust document and sign it before a notary public). Mail a certified copy to the trustee via registered mail and include a letter that explains your intentions of equitable title ownership.

What about cars? Most Americans believe that they own their cars, but the state has custodial ownership of them via the escheatment process. If one does not possess the Manufacturer’s Certificate of Origin, then one does not hold title to the car (the state gets it in the vehicle registration process). Thus, a Certificate of Title (which the state gives the “owner”) is a wall decoration that can be exchanged (which is really a change to the trustee), but does not indicate ownership of the property. Fortunately, this issue can be remedied by making the state secretary of Department of Transportation the trustee of a car trust, then conveying a certified copy of the trust document to him/her, who is already holding the legal title.

While one may find this information disturbing, consider that these deceptions have existed for hundreds of years. Look at these verses from the 1599 Geneva Bible: Proverbs 11:15, Ecclesiastes 2:21, and numerous verses from Isaiah (but especially 59:8 & 14). Most importantly, read the first footnote for Revelation 13:16. Finally, one ought to claim and protect one’s belongings, including family members; it is the only way to acquire freedom from oppression and tyranny in the United States.

Interesting postscript: A search warrant is a type of legal title, even though it is temporary; so a trust can be written nunc pro tunc ab initio (back to the beginning) to claim equitable title to property searched or seized by government officials and/or officers, making them vulnerable to suits in equity for breach of trust–potentially worth millions of dollars. :)
