Betsy Davos was a terrible choice for Secretary of Education. In fact, there shouldn’t even be a Department of Education, it is unconstitutional.
Charter Schools are the bane of education and this is all we are going to see under Davos. Charter schools are decidedly un-American and will embrace extremist philosophies such as Sharia Law.

Dave, Dave, Dave … Charter Schools, Quality Public Schools, & Private Schools are all inclusive Davos program. She does not agree with common core and has vowed to replace this ideology with State by State control of their curriculum in their schools. She has worked with parents, their children and the schools they attend to improve their resources and support the teaching staff so they can teach their students with exemplary results. Private schools are charter schools for the most part. The best grow as more and more parents clamor at their doors to get access to their classrooms for their children. There have been private schools that were disastrous and you don’t hear about them because they no longer exist. A Charter school is just as vulnerable to losing it’s charter if it is disastrous. Public schools have enjoyed a special exemption from this penalty even when they are disastrous. Davos will try her best to hand over the curriculums to the States for the betterment of their development and students no matter which institution is teaching them.

It was obvious she was going to get in. Her confirmation hearing was too slick. There are some people in the know who disagreed she was a good choice for that role.
So, something is up here.
That being said you are correct that the DOE (set up by a peanut farmer turned President) is unconstitutional. It can therefore be ignored by US citizens.
Didn’t know that did you? You can IGNORE anything not constitutional. BUT YOU DON’T. So live with this fault that empowers the progressives, the liberals, and the phony career politicians.
