Some Concepts Are Important
Some concepts are of overwhelming importance. Among these concepts are justice, freedom and liberty as well as the rule of law. Fashions change in our attitudes to important concepts and the law develops around these changes. Often, in changing the law we lose sight of the fundamental importance of the concept and hitch it to a series of regulations rather than concentrating on not losing sight of the concept itself. In doing so we modify a concept of overwhelming importance so as to render it almost sterile.
We are at risk of these concepts becoming more honoured in the breach than in the observance. Thus freedom becomes control, justice becomes injustice and liberty oppression.
