Lawmaker: NC Secretary of State Issued Notary Public Authority to Illegal Aliens

A North Carolina state Representative has called for the resignation of Secretary of State Elaine Marshall, a Democrat, because he says her office failed to properly vet residency documents and therefore commissioned hundreds of illegal aliens as notary publics.

And Republican Rep. Chris Millis says if Marshall refuses to resign, he will initiate impeachment proceedings against her.

In information he released on Tuesday, Millis said records he obtained from a request to the Secretary of State’s office revealed that more than 320 individuals were granted official notary public privileges, but did not possess evidence of legal residence in the United States, as required by state law. Such proof would come in the form of a Permanent Resident Alien Card (most commonly known as a “green card”).

Instead, Millis said, records he reviewed showed that in many cases — more than 250 — Marshall accepted “DACA cards” as proof of legal residency, which were issued under the Obama administration immigration policy known as “Deferred Action for Childhood Arrivals.” Those who hold such identification are not conferred with a status that they are in the U.S. legally; They are only granted authorization to work in the country until their immigration status is resolved.

He also said an additional 72 notaries were not DACA status, but “of various immigration statuses and categories.”

Millis said the records of one Marshall-authorized notary public even had a final order of deportation.

As Millis noted, notary publics act as authoritative representatives of the State of North Carolina, validating transactions and documents such as deeds of trust, wills, powers of attorney, and absentee ballots — the latter of which caused him great consternation.

“In this era of heightened sensitivity to voter fraud, election interference, and tension over immigration policy,” Millis said in a statement, “it is especially troubling that the Secretary has commissioned more than 320 alien notaries who can singlehandedly validate absentee ballots…including a notary the Secretary commissioned who is slated for final deportation.”

Millis also accused Marshall of misleading the public about policies and procedures regarding issuance of notary public privileges. According to Raleigh-based North State Journal, officials with the Secretary of State denied in media appearances that they accepted DACA cards as verification of legal residency. But during the same time frame — following a February expose’ of the practice by the newspaper — Marshall sought a legal opinion from then-Attorney General Roy Cooper (who is now Governor), a fellow Democrat, to determine whether DACA identification could be legally accepted under North Carolina’s notary public law. After much deliberation, and an initial conclusion that DACA cards should not be accepted, the state Department of Justice opined that they could be accepted.

According to North State Journal, “The multiple drafts and meetings to obtain an informal opinion on the matter occurred after the first press reports of the practice and years after the initiation of the policy.”

Millis considers Marshall’s actions as illegal execution of her duties, followed by efforts to hide her wrongdoing.

“It is very important for people to compare the evidence presented in my letter with the misleading and false statements made by the Secretary and her office,” Millis said. “Her repeated deception in this matter and her office’s attempt to cover up these actions from both the public and the press compound the Secretary’s malfeasance. These troubling revelations should be a sufficient basis for her to resign her office, or, should she refuse, provide grounds for the legislature to demand her impeachment.”

Marshall responded by dismissing Millis’s accusations as a political attack.

“This is simply a rehashing of the political attack used by my opponent [Michael LaPaglia] in the recent election,” she said in an afternoon statement. “The U.S. Department of Homeland Security has authorized the specifically mentioned notaries to work here lawfully. That federally authorized status continues to be unchanged by the new Presidential administration.”

But DACA was an opinion and policy exercised by the Obama administration, not a legal status upon which other jurisdictions’ governments base their laws.
