Two days ago AUN-TV revealed that Federal Judge Murray Snow was targeting Sheriff Joe Arpaio in court as the Judge, despite the fact that both Judge Snow and his wife Cheri Snow have a conflict of interest with Arpaio. Now Sheriff Arpaio is bringing that matter to the attention of the Court, he has filed a motion to Disqualify Judge Snow based on Snow’s conflict of interest.

1. 28 U.S.C. § 455(b)(5) Requires Disqualification of Judge Snow
Due to Spousal Relationship.
Under 28 U.S.C. § 455(b)(5), a judge shall disqualify himself in the
following circumstances:
(5) He or his spouse, or a person within the third degree of
relationship to either of them, or the spouse of such a person:
…
(ii) Is acting as a lawyer in the proceeding;
(iii) Is known by the judge to have an interest that could be
substantially affected by the outcome of the proceeding; or
(iv) Is to the judge’s knowledge likely to be a material
witness in the proceeding;
