WARNING: House Bill 1376 re. Circuit Court Would Take Over Some of the Justice of the Peace Powers
***** Representatives: Please VOTE NO on HB 1376 *****
HB 1376 must be killed. This bill will come up for a Full House Vote Thursday, February 2, 2017 at 1:30 pm. (Yes, that’s today!!) The title of HB 1376 is “To Clarify the Duties of a Justice of the Peace”. You can not trust the titles of bills — they are often misleading and the total opposite of the wording in the bill!
But HB 1376 has nothing to do with clarifying the duties of the Justice of the Peace! Instead, it rather eliminates the duties of the JPs that could have protected the rights of the people to defend themselves without the congestion of the courts and hefty costs of hiring lawyers… and it transfers some of the duties of the Justices of the Peace to the circuit courts! According to our Arkansas State Constitution, Article 7 Section 28, these minor issues were intended to be handled in the local township, and we need to support our local government! There is a big push — all around the country – to reduce the powers of local government and local officials and to take away power from voters. This is NOT good! (We have been warning you about this for years, remember.) This is a progressive agenda to eliminate local control and to remove people’s ability to govern themselves. (Keep in mind that there are progressives in both major political parties.) This bill, and others like it, shows a gradual move to reduce and/or eliminate our cities, townships, and county authorities. For example: in case you weren’t aware, many states no longer have constables. (Constables knew what was going on in our neighborhoods. The office of the Constablehas been totally eliminated in almost half the states!) This agenda is to replace elected officials who are answerable to the voters and residents with hired professionals who are answerable only the organizations and people who put them into power.
Local government is very important, and Justices of the Peace (JPs) simply do not know the actual power they have! Click here for a pdf copy of the “Arkansas Justice of the Peace Procedural Manual.”
JP’s are a literal judge of their own township! This is a good thing, folks! That’s why we elect them.
Attention Lawmakers: Why do they want to further congest the circuit court system? AND why would you want to risk violating Article 7 Section 28 of our Arkansas State Constitution — which would also be a violation of your personal oath that you took before God and man to support our constitutions?
Lawmakers, if you won’t vote “no”, please consider voting “present” on this until you further understand the agenda behind this bill!

HB 1376, if passed, will make the following changes:
ACTION: PLEASE HURRY! Contact our Arkansas State Representatives by email and phone IMMEDIATELY, and tell them to VOTE NO on HB 1376! You can email them all at one time. And PLEASE call them! Their names and contact numbers are below this list of emails. You may call the HOUSE Session Number at 501-682-6211 and leave a message for your state representative, and if you’re not sure who your representative is, tell the person who answers your call in what county you live, and she/he can help you.
