Currently assisting a disabled individual involved in the criminal justice system in Boulder County, Colorado.
This individual is indigent, living far below the poverty line.
In most counties I have successfully been able to have all court costs waived by filing a Motion and providing a Certificate of Indigency [JDF 203[1]]. This would be in compliance with Section 13-16-103 C.R.S. [Colorado Revised Statues].
However in The Republic of Boulder it is apparent that the same standards do not apply!
Discussing the case with the Collections Investigator I could not believe my ears…
“We will pursue this case and keep it on the books, even if the person is DEAD!”
Apparently all of the other counties are Not in Compliance with State Law. “Just wait until they are audited!” was the justification for such ruthless pursual of fees.
The court fees are not excessive, but when each day is a struggle for shelter and food, even small court fees are overwhelming.
During my last excursion to the Republic of the Elite, the city did not seem to be suffering economically. In fact there was a huge building boom going on, plenty of upscale retailers and of course the prestigious CU Boulder!
I guess they will have to reposses the only asset he has, his dog.
