Apple Dropping Patent Claim Against New Samsung Galaxy Smartphone

After receiving a promise from Samsung that they will not market their new Galaxy S III Mini smartphone in the US, Apple has agreed to withdraw patent infringement claims against the South Korean tech giant’s new device.
The agreement between the two rivals was disclosed by the Cupertino, California-based firm on Friday in the US District Court in San Jose, California, reported Dan Levine of Reuters. The Galaxy S III Mini was one of several Samsung products added to Apple’s existing patent-based litigation against the company last month, he added.
Samsung had argued that the Galaxy S III Mini was not available for sale in the US and should not be included as part of the case, but Apple representatives claimed that their attorneys had been able to purchase “multiple units” of the smartphone from Amazon.com’s US-based e-commerce website and had them delivered domestically.
“Samsung represented that it is not ‘making, using, selling, offering to sell or importing the Galaxy S III Mini in the United States,’” Levine said. “Based on that, Apple said it agreed to withdraw its patent claims on the Mini, “so long as the current withdrawal will not prejudice Apple’s ability later to accuse the Galaxy S III Mini if the factual circumstances change.”
“Apple will agree to withdraw without prejudice its request to include the Galaxy S III Mini in this case given Samsung’s representation that it is not making, using, selling, offering to sell, or importing that product into the United States,” the iPhone and iPad manufacturer said in their filing, according to CNET’s Steven Musil.
The Galaxy S III Mini runs on Android 4.1 Jelly Bean and includes a high-end, 4-inch Super AMOLED display, a dual-core 1-gigahertz processor, 1 gigabyte of RAM, and 8GB of internal storage, Musil said. The device, which went on sale in Europe in October, is unlocked and supports either AT&T or T-Mobile, but is not 4G LTE compatible.
