Countdown to Firearms Carry – Deadline Draws Nearer for Illinois

Illinois --(Ammoland.com)- On Dec. 11, 2012, the U.S. 7th Circuit Court of Appeals, in the case of Moore/Shepard vs Madigan, gave the IL state legislature 180 days in which to pass a reasonable carry law.

The deadline of June 9, 2013 is fast approaching and there is a lot of speculation about what will happen in the courts if a carry law has not been passed by the mandated deadline.

After hearing conflicting reports about what will happen come June 9th 2013, IllinoisCarry sought the expertise of Second Amendment legal experts. In their opinion, once the deadline is reached and the mandate is entered, it will be transmitted to the two District Courts where the cases originated, who will almost immediately enter injunctions that should be based on our prayers for relief.

It won’t be a complicated task and will probably take only minutes, hours, or at worst just a few days. There is nothing to work out, negotiate, or discuss. Each judge will have to enter an injunction against the IL ban on carrying a firearm in public by non-prohibited persons.

Some have speculated that this process can be drawn out for another 3-4 years after the mandate and we find that to be ridiculous. We can look at the experiences in McDonald and Heller. Once the Supreme Court mandate was issued, and filtered down, the bans went away very quickly.

It remains to be seen if the Illinois Attorney General will petition for cert to the U.S. Supreme Court. It also remains to be seen if the IL General Assembly can muster the needed votes to pass a carry law.

Contact your state representative and state senator. Politely but firmly tell them to vote NO on any carry bill that does not include shall-issue, statewide preemption, commercially available training, and carry on public transportation.
