Arrested For Shooting Down A Drone Hovering Over Your Yard?

A drone could hover a few above your lawn and you would have no legal right to do anything.

That’s because there is no clear doctrine on how far into the sky property rights extend. Instead, there are two conflicting and vague standards. The Federal Aviation Administration (FAA) contends that Uncle Sam controls all the airspace in the United States – even the space directly above your lawn — while common law infers that property owners have some rights to the air over their land.

“There is gray area in terms of how far your property rights extend,” Jeramie Scott, an attorney at the Electronic Privacy Information Center, a Washington think tank, told The Washington Post. “It’s going to need to be addressed sooner rather than later as drones are integrated into the national airspace.”

The issue is a significant one: About 700,000 drones were sold in America just last year.

William Merideth discovered the legal dilemma over drones the hard way when one flew over his home in Bullitt County, Kentucky, on July 26, 2015. Merideth called the sheriff but found there was nothing law enforcement could do, and so he blasted the drone with buckshot from his Beneli M1 Super 90 shotgun and knocked it out of the sky.

  • If you see one flying a few feet above your property, instead of shooting it just WALK into it. Then whoever owns it can be sued!

  • We no longer have a ‘government’; we have tyrants.

  • You fly a drone on my property, I shoot it down. You do it again, I screw with you for eternity…easy math.

  • The potential for misuse of these flying hunks of junk is limitless. It was a very bad idea to transfer them from military to civilian use and it will be shown to be so from now on. Just how long will it take until the landfills run out of space as they over flow with them? Just stand back and watch the mayhem begin.

    Well I guess this really sucks for running politicians, movie stars,singers and none government entities. So much for privacy. Now we can all get drones and watch who ever and when ever we want and even into windows while they are having a um…private moment or how about pedophiles watching little kids or your neighbor watching your wife undress or your daughter. HOW FAR ARE WE GOING TO LET THIS GO? We need to start contacting our locale and state officials and DEMAND to fix this now. Let them know it could happen to them too. Make sure they know that even a private conversation can be taped and they won’t even know it. Bring neighbors and friends and family into the conversation and lets stop this now before its too late and we once again will be at the mercy of another control operation.

  • In Michigan it is called aerial trespassing, but this law don’t let you destroy another mans property aka drone.
    EMP weapons are readily available and are to most part undetectable by a drone. That’s how Iran shoots down US drones.
