Pursuant to Federal Rule of Civil Procedure 56 and this Court’s Local Rule 7, Plaintiffs respectfully move this Court for entry of an Order granting summary judgment in their favor. Specifically, Plaintiffs move for summary judgment on the claim that regulations promulgated by the Internal Revenue Service (“IRS”), extending eligibility for premium assistance subsidies to individuals who purchase health insurance through Exchanges established by the federal government pursuant to § 1321(c) of the Patient Protection and Affordable Care Act (“ACA”), exceed the agency’s statutory authority and are arbitrary, capricious, and contrary to law, in violation of the Administrative Procedure Act, 5 U.S.C. § 706.
