Brown Case: Judge Asked To Appoint Prosecutor, New Grand Jury. Under Missouri law, the judge of the Circuit Court is empowered to “appoint some other attorney to prosecute” if the prosecuting attorney has a conflict of interest. The false testimony of witnesses by itself should result in a special prosecutor and a new grand jury, but that was only one of many abuses of the grand jury investigating the death of Michael Brown.

 

Judge Could Decide To Release Eric Garner Grand Jury Documents. A New York judge will hear arguments later this month whether to publicly release the records of a grand jury hearing in the case of an unarmed black man killed after a policeman put him in a chokehold while arresting him for peddling loose cigarettes.
