Patients can’t sue Bayer AG for complications in dealing with the birth control product, Essure.
According to a Facebook group (closed group Essureproblems) that has nearly 28,000 members and a few news reports, Erin Brockovich has joined the effort to get the FDA to stop protecting Bayer AG and allow the women who have suffered injury from this device to practice their 7th Amendment rights.
Pharmaceutical protections are becoming a huge concern for the people of the United States.
People can sue a tire company for a wheel falling off after a tire buster didn’t properly assemble the tire or properly tighten lug nuts but women who have had chronic pain, tubal pregnancies, or hysterectomies associated with the insertion of this product should have the ability to pursue for reparations from a company stating a product is safe, markets it as such, and yet their lives are turned upside down because of these products.
Essure is a nickel and titanium coil inserted into the fallopian tubes that forms scar tissue to block sperm from penetrating an egg and even on the Essure website is states:
—In rare cases, part of an Essure insert may break off or it may puncture the fallopian tube requiring surgery to repair.—
They also state:
—There are reports of chronic pelvic pain in women possibly related to Essure. An Essure insert may migrate into the lower abdomen and pelvis and may require surgery for removal. No birth control method is 100% effective. Women who have Essure are more likely to have an ectopic pregnancy (pregnancy outside the uterus) if they get pregnant. This can be life-threatening. The Essure insert is made of materials that include a nickel-titanium alloy. Patients who are allergic to nickel may have an allergic reaction to the inserts. Symptoms include rash, itching and hives.
The safety and effectiveness of Essure has not been established in women under 21 or over 45 years old.—
You may be ill, injured, or be forced to take out your entire reproductive system but too bad, you can’t go after the company that produces this product because they have been shielded like the the vaccine manufacturers have.
So this makes me question why so many put their hands and their money into an agency such as the FDA and Congress for not only approving a device that is injuring women but also removing their rights to sue the manufacturer for damages.
Why do Bayer and other giants in the pharmaceutical industry get this protection from the most important products people use? Simply put, the system, government and industry, is not a free market economy. This is a corporatist economy where the politically connected get shielded from your Constitutional rights.
In a free market, you can go before a jury and let a jury decide if the manufacturer, the doctor, or others involved in this process are liable for your injuries.
Those rights are still yours, regardless of what the law says, so all it has to take is millions of people banding together to tell Congress that the FDA must be dismantled and the laws protecting BigBusiness must be shattered because BigBusiness, especially BigPharma, is shattering the lives of the individual and the three documents that make up the founding of this country which were set in place to protect the individual, not BigBusiness.
