Rapper Pitbull has defeated Linsday Lohan in court after the actress/singer sued him for using her name in his 2011 hit, “Give Me Everything.”
After hearing the lyrics “So, I’m tiptoein,’ to keep flowin’ / I got it locked up, like Lindsay Lohan,” the troubled star filed lawsuit claiming the song caused emotional distress and violated her publicity rights for its “unwarranted, unauthorized, and unfavorable mention of [her] name and personality, and allusions to [her] physical and mental character.”
On Thursday, however, U.S. District Judge denis Hurley ruled that Pitbull’s song was a work of art protected by the First Amendment, adding that the single mention of her name weakened her argument.
The rapper’s legal team also claimed Lohan should be sanctioned for filing a “frivolous” lawsuit, but Judge Hurley did not agree. However, Lohan’s lawyer, Stephanie Ovadio, was sanctioned for plagiarism after it was reported that her court briefs had been put together using newspapers, law firms, and legal websites. She was fined $750.
