Update 9 Referendum Challenge

Dear Friends,

This is just a reminder that the Referendum Challenge case begins on Tuesday April 16th at 10 am in the Four Courts, Dublin. Also to remind you that anyone is welcome to attend any/all days of the case.  The hearing is expected to run for 6 court days (not necessarily consecutive) in the High Court but this is just a guess. We will keep you posted on the schedule and events. We will attend as many days as I can and stay in touch with Joanna Jordan, the courageous petitioner and the legal team for information on days that one of us cannot be there.
As you are aware, this case challenges the result of the Childrens Rights referendum maintaining that because of illegal activity on the part of the government the referendum result is “unsafe”.  It also challenges the Referendum Bill as unconstitutional in its criteria (as interpreted by the Hanafin judgment) for determining the outcome of a challenge. This is a historic case and the future of the true rights of children, parents and families and of the sovereign right of the Irish people to fair and free referenda are at stake.
The case starts in the High Court but will inevitably wind up in the Supreme Court because is we win in the High Court the government will, I am sure, appeal. And if we loose in the High Court, we will appeal.  Remember Mark McCrystal’s case against the Department of Children and Youth Affair’s illegal activity in the childrens rights referendum (which is the precursor to this challenge) lost in the High Court and got a unanimous victory in the Supreme Court.
Thank you for all of your support for this case. Your ideas, information, research and other varied services in preparation have played a role preparing for Tuesday. Also your financial support has been amazing. We have covered all the outside expenses and fees to date. We are still trying to cover the immediate hearing expenses like bringing the expert witnesses to Dublin and already one of them has been cover with donations over the last week… Well done and thank you all again.
And special thanks to the petitioner Joanna Jordan, Brophys, the legal team, Catherine Donnelly and Paul Sreenan the Counsels,  the expert witnesses, everyone who has done affidavits and those who will be called to witness. Please pray for them, they are putting themselves on the line for us.
