The Bureau of Alcohol, Tobacco, Firearms and Explosives settled Monday with veteran agent Vincent Cefalu in its legal termination proceedings against him, a post on the CleanUpATF website forum revealed. The case, presented this morning to Judge James Donato in the United States District Court for the Northern District of California San Francisco Division, resulted in a dismissal of ATF’s proposal to terminate Cefalu, negative allegations expunged from his record, mitigation of legal fees, the agent’s retirement in good standing at the end of the month, and an undisclosed settlement*.

Cefalu had earlier won a stay in termination proceedings against him from the U.S. Merit Systems Protection Board in October 2012. Basing his termination “on a single … charge of lack of candor” related to his testimony in a criminal case “cannot be sustained,” the Office of Special Counsel concluded, explaining Cefalu was sharing his opinions under cross-examination, had “fully disclosed” his limitations while sharing “subjective opinions based on … experience…and he was ‘sincere.’”
