Cop Post to Craigslist: “You DO NOT Know Your RIGHTS”

So check it out… I hope you all read this, and teach your kids this, and maybe even spread the word to everyone you know. I am a current sworn police officer, and for the first time in my life I am going to take to the internet and social media to spread one simple tip… Listen to what a police officer tells you to do and everyone will be fine. All too often I have a suspect tell me, “I know my rights.” in the course of my daily business in dealing with people. Let’s face it, you may have Googled your rights, you may have read a book or a newspaper article, you may have had a friend of a friend of a friend tell you your “rights” but you do not know them. Google does not automatically turn you into an expert in law and Constitutional rights. Police officers have a hard enough job, and we do not need so called Google law experts telling us what we can or cannot do as we try and conduct our business. Here is a perfect example of what I dealt with last night as I am one of three officers responding to a domestic. The conversation went like this:
Me: “Sir, please do me a favor and sit down, take a few breaths, calm down, and I’ll be right with you.”
Subject: “Are you detaining me?”
Me: “No, I am not. I have to make sense of what is going on here so just sit down, calm down, and I said I’ll be right with you.”
Subject: “Am I under arrest? If so, for what?”
Me: “No, you are not under arrest. I’m going to ask you one more time, everyone is angry and I get it. Just sit down, take a breath, calm down, and I’ll be with you in a few minutes.”
Subject: “Well if I’m not under arrest I don’t have to do what you say so I’m going in my house.”
Me: “Now, you are under arrest for failure to comply with a peace officer’s orders.”If this gentleman would have just listened to me he would not have an arrest on his record like he does now. This is the case for every police shooting that has happened in recent times. Ferguson, South Carolina, Baltimore…and most likely all the other shootings we don’t hear about. Teach your kids, and your friends, and your family…you DON’T know your rights. Just listen to a police officer’s very simple commands and 95% of the time you will go home with maybe a ticket – at most. If not a misdemeanor arrest that will probably get thrown out in court. Us police officers really don’t want to go hands on with anyone let alone escalate force on someone. You, the citizen, puts us in a position to do so. Us police officers DO NOT get out of our police car and say to ourselves, “I want to shoot this person today.” You, the citizen put us in a position to do so. Just listen to us and everyone and everything will be just fine. I promise you that.

Well that was enlightening, ok, I’m joking it wasn’t enlightening at all. Unless you take it from the perspective of the cop and how they expect – or desire – you to simply do whatever they demand. Like in the example above. Legally the ‘subject’ didn’t have to follow the officers ‘order’ because it was an unlawful one. If the subject was being detained, arrested or even investigated than he MAY have had to listen to the officer. Yet, since the officer clearly stated he was not being detained or arrested, he had no LEGAL obligation to follow his order, which isn’t an order but merely a request at that time.
Even without the hole in his example this is still horrible advice. To do whatever a cop tells you seems logical to some people, yet, the reason why isn’t as clear. The reason people advocate doing everything an officer says is because the police are known to escalate a situation to the point where they use force, sometimes deadly force, on a person. People fear being ticketed, arrested, beat up or killed by the police, and rightfully so, but instead of combating this people merely become complacent.
This is what has allowed the police state to grow to epic proportions. From regular checkpoints, stop and frisk and victimless crimes arrest the police are becoming more intrusive, aggressive and armed by the day! If you don’t believe me just spend 2 hours on this website (and feel free to check out PoliceOne.com for their perspective too). Since the police are so heavily armed, tasked with enforcing laws they don’t even know (or understand) and demand obedience the best thing to do is to FILM THE POLICE during every single encounter. I highly doubt the ‘subject’ above would have been charged with a crime had he asked those questions with a video camera rolling. So forget the rights the government claims you have, they don’t mean shit to them – cops or government – anyways, and grab your camera!

To the author of the CL post (not the Officer), you’re a moron. You have absolutely no idea what was happening at that scene and how DARE YOU propose that you do. You’re stating that the man who was merely asked to sit and calm down had every right to continue on with whatever he was doing that initiated a 911 call in the first place?

Screw this pig cop. I do know my rights. I have the absolute right to not answer ANY AND ALL questions by an officer, but it is absolutely stupid when an officer says show me your hands, or stay on the ground to not comply. They will shoot you, because they are scared thugs.
They can reasonably detain me under probable cause and suspicion. Answering no questions IS NOT grounds for suspicion. But acting nervous and answering questions inconsistently can create reasonable suspicion. HENCE NEVER ANSWER ANY QUESTIONS. Officer am I free to go, comes to mind. Also, you have the 4th Amendment right to refuse search requests, and your refusal does not create reasonable suspicion, though the officer can pat you down for weapons. LET HIM. If you are not free to go, you are being detained. The officer might have some reason to suspect you of a crime, and you may be arrested. In such a situation, your magic words are “I’m going to remain silent. I would like to see a lawyer.” then shut up, get arrested and go to jail.

In fact, look rules of evidence, anything you say to an officer can be USED AGAINST YOU. But anything you say to an officer that can help you is HEARSAY and not admissible.

Civil servants
– Voluntarily disarm yourself.
– Give me your sensitive information
– You may not know your rights.

Either, you are a member of a praetorian, military caste, or you are subject to more restrictions than the ordinary citizen, as according to the social contract.

All things being equal, what is the moral difference between this and a protection racket.
A servant, by definition, is one who expresses debt to another. You have expressed that you are a civil servant. You owe a debt to society.
I ‘m not nearly so altruistic, so do not claim to be acting on anyone else’s best interests, nor on anyone else’s behalf.

“Google Law Experts” LOL! First off; police are not “law enforcement” they are “policy enforcement.” ‘POLICE.’ Can you see it? LOL. You see the Sheriff and their deputies in the county are “Law Enforcement” in that jurisdiction. All cities are municipal corporations enforcing policies of the CITY council. Any entity that does business in commerce are considered “persons” which if you look up the legal definition it is a corporation. So in reality, the police are really “city employees” no different than the city trash man. and your petty attitude, and pray you don’t ever run into a individual like me that will have no problem using my google law degree and enforce my rights, by shoving a TORT claim up your a$$, and slapping a lien on your surety bond for your breach of your constitutional oath. SCUMBAG!!!

Something that has not been making the news, police officers getting contaminated by lead at shooting ranges. Lead poisoning effects cognitive abilities, as well as mood swings and a host of other health issues. This is a nationwide issue. Investigations are getting squashed, due to the high liability. Could this be the cause of increase police brutality??
What is actually causing the police to act violently all at once is from their helmets. Just as in the military, they have headsets in them, and they are sent subbliminal sound tones and these tones can be changed to affect their thinking. This was proven in military helmets, and that is one factor. The other is that they were told not to drink city water because its laced with medications, to calm the people…

I know this will be an unpopular statement here, but under the conditions the officer describes it is best to listen and do as told. Any judge in a case like that will side with the police.
I watch the police brutality videos and hate it, too. I hate what has happened to our law enforcement. But to me it looks like many situations are escalated before force or brutality comes into play. They wouldn’t have gotten hurt (in some cases) if they would just done what they were told. Scream about your rights all you want, I think common sense comes into play when dealing with the guys with badges and guns.
The issue is that they really don’t have the right to tell a sovereign individual what to do unless we grant them the right. Did you call the cops? Then you gave them authority. Otherwise, they don’t have any authority other than what is granted to them. I never grant authority over me to anyone, ever, because in fact no one really does have authority over me unless I say so.
I hereby grant mine subjects such authority.
So by refusing to obey orders from this “Public Servant,” then it’s your own fault that he had to arrest you? This sounds remarkably like the same logic used by a wife beater: “You didn’t do what I said so I had to hit you.” People… if you don’t yet have your Google Law Degree, here it is in a nutshell… so long as you are breaking no laws, or harming someone or something, no one has ANY authority over you. None. Ever. That’s really all the law you need to know. Incorporate it into your persona and live it.
So now anyone who googles their rights should not be taken seriously? So if I have a question about my rights, and Google answers my question with a link to a website that has the Constitution posted, this does not count? Why, because you the dirty cop, says so? Sorry, that just doesn’t make sense. And I don’t believe a word of your report on how you handled that person last night.

Why does everyone blindly accept that the “corporate” governments laws, codes, statutes, edicts, rules and regulations apply to the private person without EVER questioning it?? Obviously there are going to be some idiots whose opinions are in lock step with government employees, their indoctrination to blind obedience is unshakable.. BUT CAN ANYONE ACTUALLY PROVE THEIR LAWS APPLY TO THE PRIVATE PERSON?? Can you??
IF you ask government employees if their CONstitution and laws automatically apply to everyone just because of their physical location within what we commonly refer to as a state, their collective opinion is that YES, their CONstitution and laws apply to everyone, automatically. BUT if you ask them what facts they rely on that PROVE their BELIEF that it is applicable to you, they have no plausible answer. They can’t believe you would even question their laws. They’ll ignore the question as though you never asked it, they’ll hang up on you, feign as though they don’t understand the question, tell you that they aren’t going to debate with you “EVEN THOUGH ALL YOU DID WAS ASK FOR FACTUAL PROOF OF THEIR ASSERTION OF JURISDICTION” They’ll tell you that it’s common knowledge that it applies and you, like them, should just accept it without any evidence of applicability whatsoever, they’ll even tell you to prove it doesn’t apply to you, this is all an attempt to avoid answering your question!!, but they’ll continue to refuse to answer as to what facts they rely on to prove any of it applies to you, BECAUSE THEY DON’T HAVE ANY FACTS THAT SUPPORT THEIR BELIEF, BECAUSE IT NEVER EXISTED!.. remember, they already told you it applies, it is their responsibility to prove it applies because they are the ones attempting to bring a charge against you, so the onus to prove it applies is theirs,.. It is not up to you to disprove anything applies!!!
Everyone has been told that the CONstitution and law automatically apply to everyone. it’s everyone’s opinion that it applies, everyone feels it applies, everyone believes it applies, everyone assumes and presumes it applies. HOWEVER; hearsay, opinions, feelings, beliefs, assumptions, presumptions and or so called common knowledge aren’t proof of a damn thing.
What factual, first hand, irrefutable evidence can anyone offer that proves that their CONstitution and laws apply to the private person simply because they are physically in what we commonly refer to geographically as a state.
Keeping in mind that slavery and involuntary servitude is illegal “per their own laws”. Further, no private person is a party to their CONstitution, nor is any private person a signatory to their CONstitution, nor has any private person sworn an oath to be bound by or to obey the CONstitution and laws.
Padelford, Fay & Co. v. Mayor and Aldermen of City of Savannah 14 Ga. 438, which states the following;
But, indeed, no private person has a right to complain, by suit in Court, on the ground of a breach of the Constitution. The Constitution, it is true, is a compact, but he is not a party to it.

Who precisely is a party to their CONstitution?? The States are parties to the CONstitution. NOT YOU, THE LIVING BREATHING FLESH AND BLOOD MAN/WOMAN!!
