Mesa Police Violate a Father’s Rights in Order to Protect His Kids

ColorLogoSm Brian Merrell has been in a battle with his ex for several years and back in May said person called the police claiming the children hadn’t been seen in three days. Instead of doing real police work the Mesa Police assaulted a Father and failed to protect anyone, including the kids. Brian stated via his Facebook page that:

I don’t ask for help very often. I am to my breaking point with this situation though. I have been the victim of domestic violence for years. I am forced to continue to deal with my abuser by court order. Back in May my abuser called the police saying that they were concerned for the well being of my children. I then had my home invaded by the police. The video is of this incident. This person has continued to make false allegations and has recently called DCS (formerly CPS) making further false allegations. I believe this is an attempt to remove my parental rights. Which has been continuous for the past 5 years. I cannot not afford an attorney. Currently I have domestic violence charges stemming from a supposed phone call that I would not allow between this person and the children. This person for years has refused my phone contact with the children. The state has continued to refuse to press charges against this individual. The City of Mesa Police refused to do a complete investigation and completely ignored the evidence I have provided to them. I was hung up on this morning by the City of Mesa Prosecutor’s office when I asked why as a victim for so long why I have no rights to protect myself from this individual. They hung up on me.

I am asking that you share this post. If anyone knows of someone that could help me I would be very appreciative.

Aside from the legal battle and pending charges, which appear – at least to me – to be unfounded, Brian’s rights were clearly violated here. Sure, the police did what they were supposed to when they knocked on Brain’s door asking to see his children. Yet, Brain was also correct to refuse the officer’s entry into his home without a warrant and the police should understand that. After all, they are officers of the law.

Instead, one of the Mesa Police officer stuck his foot in the door and all three officers rushed Brain. They tackled him to the ground and went on one of the most ridiculous rants I’ve ever heard. The officers said things like:

“We don’t need a search warrant.”

Really? I guess the good old fourth amendment just went out the window then?

“Are you an adult or are you a child?”

This was asked when the officers when handcuffing Brian and is such a contradiction because the officers were the ones acting like children, throwing a fit in the namesake of protecting the children.

“We just want to check on the kids.”

Officer’s repeated this several times and even said, “We’re sorry we care about your children.” *HEAD HITS DESK* Seriously? You care so much about the kids and so little about people’s right to be secure in their home from search or seizure! Maybe Brian should call these officers the next time his kids need new shoes or when it’s time for them to go to college. Maybe then we’d see how much these officers really care.

Fact is these officers didn’t give a damn about anything other than compliance. They didn’t like that Brian wasn’t bowing without questions and they used the children to disguise their violations of Brian’s rights. This is made clear when the police are forced to uncuff Brian and finally acknowledge Brian’s request to leave his home. They knew that without a valid claim of abuse they wouldn’t have a leg to stand on in court.

Of course the police still went on with their business when charging Brian with a domestic charge for allegedlly making a phone call, but remember, this allegation came from the same person who sent police to his door in the video above. That person was clearly wrong – as the police spent more time harassing Brian than it took to ‘check’ on the kids – and seems to be using the police to gain an edge in a custody battle over children. Too bad the police were more concerned with ‘protecting the kids’ than they were about doing real, honest police work.
