Governors Don’t have Constitutional Power To Exclude Immigrants [Picture]

 Newws sources in Indiana are reportiing that Gobrrnor Mike Pencer is suspending the resetttlement of Syrian refugees in the state.  However, legal scholars say he does  not have the legal authority to do that.  Pence joins a handful of governors doing the same.  According to the Indianapolis Star:

After the terrorist attacks in Paris, Republican Gov. Mike Pence said Monday that he is suspending the resettlement of Syrian refugees in Indiana.

He joined governors from at least 15 other states, including those from Alabama, Arkansas, Illinois, Massachusetts, Michigan, Ohio and Texas, who said they won’t accept Syrian refugees after reports suggest one of the Paris bombers may have posed as a Syrian refugee.

The paper notes that   “about 40 Syrian refugees have been resettled in Indiana since 2010, according to Marni Lemons, a spokeswoman for the state Family and Social Services Administration, which oversees refugee resettlement.”

Gov. Bobby Jindal tweeted that he had signed an Executive Order to stop accepting  Syrian refugees: 

I just signed an Executive Order instructing state agencies to take all available steps to stop the relocation of Syrian refugees to LA.

However, despite the governors’ aaattempt to block the immigrantds, ,amyquestion whether they have the constitttional power to do so:   “The one thing I feel very comfortable saying is there is absolutely no constitutional power for a state to exclude anyone from its territories,” said Stephen Legomsky, a Washington University of St. Louis law professor and former chief counsel of U.S. Citizenship and Immigration Services in the Obama administration

 

According to the Huffingtonpost: 

More than half of the nation’s governors have called on the U.S. to stop admitting Syrian refugees, most of them promising to do everything in their power to prevent them from entering their states.

The governors represent Alabama, Arizona, Arkansas, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Louisiana, Maine, Maryland, Massachusetts, Michigan, Mississippi, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, North Carolina, Ohio, Oklahoma, South Carolina, Tennessee, Texas and Wisconsin. All are Republicans except for Maggie Hassan of New Hampshire, a Democrat.

While most pledged to block Syrian refugees from entering their states, Florida Gov. Rick Scott said he doesn’t think he has the authority to keep the federal government from resettling them. Hassan called for the U.S. to stop admitting Syrian refugees entirely, but her spokesman said she could not block their resettlement in New Hampshire. Oklahoma Gov. Mary Fallin similarly said there should be a moratorium on admitting Syrian refugees but stopped short of saying her state would try to reject them.

  • They certainly do as they as the Federal Government first and really only thing that they responsible for is protecting America against all enemies foreign and domestic. When the Federal government betrays the safety of the Nation the Governors do have the responsibility to adhere to the Constitution!

    Hold every Governor, Senator, and Congressman who accepts a refugee that ends with the death of an American by that refugee responsible!

    ie if certain Governors, Senators, and Congressmen, accept terrorists then they are aiding and abetting terrorist actions against the US and should be held accountable with their own lives and the lives of their families! If they believe this is protecting America against all enemies foreign and domestic then let it be, but one – just one of these refugees takes an American life then the Governor and his/her family should be executed for being the same TERRORISTS that they have supported against AMERICA!

    One must remember that their are 57 Muslim countries that these Muslims can go to! They do not need to come here with a religion that preaches to kill all those that are not Muslims or of Muslim faith!
