After CA Jihad attack: It’s time to rethink K-1 Visas

Undemanding conduit for tech savvy terrorists

The San Bernardino Islamic jihadist massacre that rocked our sensibilities on Wednesday raises yet another immigration question.

Reports indicate that terrorist Syed Rizwan Farook, 28, was a U.S. citizen whose parents are from Pakistan. In 2013 he brought Tashfeen Malik, 27, a Pakistani he met online, to the U.S. with him from Saudi Arabia on a K-1 Visa. His co-terrorist Malik, the mother of an infant daughter was easily able to become a lawful permanent resident.

How? Through a obscure machination known as the K-1 Visa authorized by the U.S. Citizenship and Immigration Services.

Although a K-1 or “Fiancée Visa” usually take a few months to process and payment of a nominal fee, it allows immediate immigration and eligibility for legal employment in the United States. With the relative ease of bypassing more cumbersome application procedures, K-1’s are considered to be a high fraud visa category.

To curtail abuse of this foolishly generous system, the couple must provide evidence that they have actually met in person. Both must be of legal age and not already married to each other or to anyone else. The K-1 visa holder is required to marry his or her U.S. citizen petitioner within 90 days of entry. All of these regulations appear to be enforced by the honor system, since there is no discernible requirement for federal oversight.

In 2014, the Department of State issued a total of 35,925 K-1 visas to fiancées of U.S. citizens. Including K-2 and K-3 ‘derivative’ categories — mostly for children of fiancées — a total of 41,488 such K category visas were issued including adoptive, step-parent, and half-sibling relationships.  A K-4 visa is an even further extended derivative visa issued to the child of a K-3 visa holder. So now we’re getting into the realm of grandchildren.

Where it stops, who monitors this system and how screening is implemented is anyone’s guess. Meanwhile our world becomes less safe as Barack Obama opens the floodgates to tens of thousands more Muslim Syrians claiming refugee status.
