Fox News Senior Judicial Analyst Andrew Napolitano said in a Thursday Fox News interview that the United States Department of Justice will likely seek to make deals with individuals who were top aides to Hillary Clinton so those aides will testify against her if there is a prosecution of Clinton for failure to adequately protect government secrets while she was US Secretary of State.
Napolitano cites in the interview new revelations that these top aides “regularly received from Mrs. Clinton, via her private server, top secret emails … which the aides lacked the security clearance to receive.” The aides’ “acceptance, discussion, and transfer” of these emails, Napolitano continues, “is a felony.” This provides, Napolitano concludes, the Justice Department with the opportunity to indict the top aides and then trade them lesser or no penalties in return for testimony against Clinton.
Such deals are common in prosecutions by the US government. As Napolitano comments in the interview, “this is the way the government works.”
