Texas vs Barack Obama: The Battle Begins…

Flying a bit under the media coverage radar was an important legal challenge initiated by the state of Texas this week against President Barack Obama that has the president being accused of knowingly and illegally expanding his Executive Authority in regards to the sweeping transformation of national immigration laws without the consent of Congress and in violation of a recent federal court opinion.

And Texas ain’t messing around…

Texas is leading the charge for itself and twenty five other states in calling out Barack Obama’s actions as unconstitutional. Those actions ignore standing federal immigration law, and would grant sweeping amnesty privileges to nearly five million illegals currently residing in the United States.

NBC news reported the following:

“Texas further argued that the president cannot claim a crisis on the basis of his frustration with Congress for failing to pass an immigration reform bill. “Congress’ choice not to enact this sweeping, new immigration reform implicitly rejects the notion that an emergency need exists,” the state contends.”

The legal action was then sent to U.S. District Judge Edward Hanen who was the judge who handed down the original temporary injunction against the Obama immigration policy last month.  Hanen has since received considerable pressure from within the Obama administration to reverse his ruling.
