It would seem, at least to me, that the U.S. attorney’s office has had some difficulty in coming up with an adequate explanation of why it misled U.S. District Judge Andrew Hanen and the 26 states that are challenging the immigration initiatives being carried out by the Obama administration.
Hanen has allowed the government until Thursday (April 30) to come up with that explanation. That date was changed from April 21, at the government’s request, saying more time was needed. Yeah, more time to deveive the court even more?
At issue are that the government attorneys said several times that no action would be taken before Feb. 18 on applications for an increase in stays and work authorizations from two to three years under the 2014 amendments to the Deferred Action for Childhood Arrivals program.
Hanen had issued a temporary injunction on Feb. 16, that blocks the implementation of the initiatives pending resolution of the legal challenge filed by the states.
But then, the attorneys provided an advisory to the court that the government had issued three-year renewals to 108,000 illegal immigrants. then later advised that the number does not include 55 applicants who received the benefits after he issued the temporary injunction.
A furious Hanen told Justice Department attorney Kathleen Hartnett on March 19 he had stopped the programs temporarily on Feb. 16 because the government had assured him that applications for the expanded DAC would not begin until Feb. 18 and that he believed it “like an idiot.”
Meanwhile, the Fifth Circuit of Appeals is still pondering the arguments on whether to overrule Judge Hanen and let President Obama’s executive act to let the some 5 million illegal immigrants apply for renewable work permits and reprieve them from deportable action.
This still could take weeks for a ruling.
