UGENTI CITES IMMUNITY TO BLOCK SUBPOENA IN DIVORCE Ugenti is citing her legislative privilege in an attempt to block a subpoena from her husband’s divorce attorney that seeks to obtain several months of her text messages. Ugenti’s attorney,

David Rose, filed a motion Wednesday seeking to squash a subpoena filed by Falynn Baum, the attorney for Frank Ugenti, seeking the lawmaker’s text messages since Feb. 1. Rose said the texts are both protected by legislative privilege and irrelevant, because the couple has already settled custody issues and there is no financial information Frank can learn from the messages. Rose wrote that Frank “seeks these records because he seems to think that [his] wife is having an affair. Whether or not [the lawmaker] is having an affair is completely irrelevant, under Arizona law, to any of the remaining issues in this case.” In a May 16 letter to Frank Ugenti’s attorney, Falynn Baum, that was included as an exhibit to the filing, Rose wrote that the husband is seeking the records because “Frank apparently has some sort of vendetta with Ms. Ugenti’s co-worker and while I am not going to fight their particular fight, this subpoena simply proves my point.” Ugenti filed for divorce against her husband in March of this year.
