New Jersey Cruz Birther Case Decided
New Jersey’s Secretary of State, Kim Guadagno, rejected a challenge to Sen. Ted Cruz’s eligibility to run for president. Guadagno issued a ruling Wednesday accepting the decision of Administrative Law Judge Jeff S. Masin of the New Jersey Office of Administrative Law.
Judge Masin’s decision found that the plaintiff, law professor Victor Williams who is running for president for the sole purpose of bringing yet another birther law suit challenging whether Sen. Ted Cruz is a “natural born citizen” eligible to be elected president, did have standing to challenge Mr. Cruz’s eligibility. Judge Masin went on to review the history of the Constitution and concluded that its authors had intended that someone born to American parents, no matter where the location, was a “natural born” citizen:
“As such I conclude that Senator Cruz meets the Article II, Section I qualifications and is eligible to be nominated for president. His name may therefore appear on the New Jersey Republican primary ballot,” Judge Masin said.
Guadagno’s ruling is the 12th decision to go against the birthers since Donald Trump tried to use the discredited issue against Sen. Ted Cruz.
Birther Williams is expected to now take his Quixotic litigation to the courts.
