The tables have turned, Samsung and HTC after Apple iPhone5 ban in US and EU for LTE
It turns out the iPhone 5 will be using the LTE radio standard for all that high-speed data that all us LTE Android owners know and love. The standard is based on a multitude of patents, some of which Samsung and HTC own. According to an insider:
“Samsung Electronics has decided to take immediate legal action against the Cupertino-based Apple. Countries in Europe and even the United States ― Apple’s home-turf ― are our primary targets.”
No legal action has been filed or made public just yet, but it shouldn’t take too long for Samsung to tackle them head on.
HTC on the other hand has already started getting their hands dirty and has presented its patent claims before a U.S. International Trade Commission Judge. Judge Thomas Pender has already let Apple’s legal team know that “Clear and convincing means something to me; I have to be pretty darn certain a US patent is invalid.” That was in response to Apple lawyers disputing the validity of HTC’s LTE patents. HTC is deep in the LTE world. They have been supplying LTE-Enabled devices for LTE capable carriers across the globe for a while now.
As much as we would like to see the newest Apple device get a preliminary injunction right out the gates, we know how slow the courts can sometimes. It is entirely possible that a judge will grant an injunction of some sort until all claims are worked out. After all the bans that Apple has been able to get imposed on devices around the globe, a small dose of their own medicine wouldn’t be to terribly bad.
