Grow Up: Apple To Pay Samsung’s Legal Fees After Original Notice Deemed “False And Misleading”

It’s no secret that Apple pretty much hates Samsung, and Samsung, Apple. And as quietly humorous as Apple’s tongue-and-cheek notice (the first one) that went above and beyond a UK judge’s orders to announce Samsung’s innocence, the added bits of information and hostility from Apple are coming back to bite them.

The same judge who originally mandated that Apple post a notice on their UK site (and those print paper ads) clearing Samsung of infringing on the iPad design has now come back to hit Apple again by requiring them to pay Samsung’s legal fees after the first notice was deemed “false and misleading”.

As The Verge notes, in the UK the losers of lawsuits are generally expected to pay their opponents’ legal fees. In this case, however, the judge is requiring it on an indemnity basis which basically makes the point loud and clear that the court is further punishing Apple.

While most Apple fans no doubt had a smirk or small chuckle creep up on them after reading the original notice which threw in verbiage citing the judge’s comments about Samsung’s tablets not being as “cool” or “iconic” as the iPad, the simple fact of the matter is that Apple is drawing out this whole spat longer than it needs to. By constantly trying to get around a simple statement like the judge ordered they instead caused far more coverage on the issue as well as a longer penalty time that the notice must stay on the UK Apple site – now until December 15th.

What started as a smirky resistance to UK court orders is now coming across as simple, childish maneuvers on Apple’s part. Seriously, Apple. Grow up. Accept your losses. Stop wasting tens of millions in the courtroom. But most importantly, move on.
