WHILE THE state of North Carolina and the U.S. Department of Justice square off in a legal battle over “Transgender Bathroom Rights”, we need now more than ever to expose the faulty logic behind this nefarious agenda, and identify why in this case – promoting minority rights at the expense of the majority, is a threat to democracy itself.
“Majority Rules with Minority Rights” is an essential principle of democracy. In every genuine democracy, majority rule allows citizens to make political decisions by voting for representatives. The representatives with the most votes subsequently represent the will of the people through majority rule.
Thomas Jefferson, the third President of the United States, expressed this concept of democracy by majority rule in 1801 in his First Inaugural Address;
“All . . . will bear in mind this sacred principle, that though the will of the majority is in all cases to prevail, that will to be rightful must be reasonable; that the minority possess their equal rights, which equal law must protect and to violate would be oppression.” – Thomas Jefferson
Minority rights are rights that are guaranteed to everyone, even if they are not part of the majority. These fundamental rights are protected by the Bill of Rights, and are not subject to the will of the majority. While these limits are rightly meant to prevent the tyranny of the majority, tension invariably exists between majority rule and minority rights. In this case, public officials are called to make decisions about two questions:
“When, and under what conditions, should the rule of the majority be curtailed in order to protect the rights of the minority? And, conversely, when, and under what conditions, must the rights of the minority be restrained in order to prevent the subversion of majority rule?” – Annenberg Classroom
On Monday, Attorney General Loretta Lynch filed a Federal Civil Rights lawsuit against the state of North Carolina’s “Bathroom Bill” or HB2, stating that it was “impermissibly discriminatory”. She then went on to make a direct comparison of HB2 to previous historic discriminatory efforts such as the Jim Crow Laws, which were meant to stifle the response to the Emancipation Proclamation which freed slaves.
Let’s stop right here.
Logic is concerned with principles of correct reasoning, and is assessed according to strict principles of validity.
Which means that in spite of how much Loretta Lynch would like to draw comparisons between the long, drawn out history of slavery and racism in early America, which culminated in a Civil War, the death of approximately 620,000 soldiers, and reached forward in the form of Jim Crow Laws following the Emancipation Proclamation from Reconstruction in the late 1800’s to the Civil Rights Movement in the 1950’s – She Cannot. There simply is no comparison, and no such struggle.
What this is more accurately is a Constitutional Monstrosity, and yet another attempt by the Obama Administration to override the concerns, rights and will of the majority by making laws which blatantly bypass the Constitution and our courts. Other recent examples include ObamaCare and Obergfell v. Hodges. And it is indeed a direct threat to our Democracy.
Let us NOT be guiled into accepting the narrative that the origins of HB2 began as the result of a noble, far-reaching humanitarian struggle – but rather, in the heart and mind and of a convicted pedophile who is a Registered Sex Offender. At our own peril we and our leaders are ignoring the wisdom of educated men like Dr. Paul McHugh, the former Psychiatrist-in-Chief for Johns Hopkins Hospital, who had the courage to state that transgenderism is a “mental disorder” that merits treatment, that sex change is “biologically impossible,” and that people who promote sexual reassignment surgery are collaborating with and promoting a mental disorder.
