Judges Unreliable Protecting Freedom Of The Press [Image]

For all of the nation’s yammering about the Bill of Rights, the truth is: we can’t really trust courts to protrct press freedom, freedom from ‘unreasonable searches and seizures or any other Constitutional right.  The courts’ interpretation of ‘our rights’ changes with the political winds.

 

Two hundred years of jurisprudence is vulnerable to political winds.  Worker rights, freedom of the press,  and other constitutional rights ride political winds, whether “conservative’ or liberal’.

A Princetn University professor argues that:   

“The Constitution did not envision a national government of general jurisdiction … but rather a government of enumerated and delegated powers. A government that had authority over only specific areas of American life,” he said, adding that “all other powers” were reserved to the states or “American people themselves.”

George said that the Ninth and Tenth Amendments have failed to curtail the growth of the federal government and that the Supreme Court has failed to keep the other two legislative and executive branches in check, resulting in a loss of freedom for the American people.  source

The soon-to-be defunct al-Jazeera writes:  

In its 2015 World Press Freedom Index, Reporters Without Borders (RSF) writes, “media freedom is in retreat on all five continents,” ranking Eritrea, North Korea, Turkmenistan, Syria and China at the bottom of its 180 country index.

Finland, Norway, Denmark, Netherlands and Sweden were given the highest ratings while the United States was ranked 49th, three spots lower than 2014 and a far cry from where it was at 20th in 2009, when President Barack Obama took office.
