Samsung’s request to Lift U.S. Injunction on Galaxy Tab 10.1 denied by Judge

Not long ago, Curpetino based company Apple filed lawsuits against Samsung with claims that the latter was producing replica devices with an aim of confusing Apple customers to buy the products assuming they were actually buying Apple products. Well, after the legal battle, Apple was favored and they were granted more than a billion dollars plus Samsung’s Galaxy Tab 10.1 was banned.

After the judgment, Samsung pleaded not guilty claiming they did not infringe any of Apple’s design patents as was claimed when the injunction was made. They requested for a lift on the ban so they could continue selling their tablet. But, Judge Lucy Koh has refused to grant their request of lifting the ban. She expressed that under all circumstances, a mandate from a Federal Court as opposed to US District Court is necessary for lifting of the ban. She admitted that Samsung’s motion was substantial but procedures have to be respected.

It is clear that Apple were wrong about what the Jury would do for the design patent D’889 and the injunction does not hold at all.
