Almost All Texas Museums Allow Concealed Carry; Amarillo College’s Art Museum Won’t

AUSTIN, Texas -(Ammoland.com)- Although most of Texas’ state-owned museums and tourist attractions, including the Alamo, the Texas Capitol, and the Bullock Texas State History Museum, are statutorily required to allow the licensed, concealed carry of handguns, Amarillo College has decided that it will not allow concealed carry in its on-campus art museum because, as the AC student paper puts it, “Children and the general public visit [the museum].”
This is just the latest example of Texas colleges using the “reasonable rules” provision of the state’s campus carry law to usurp the clear intent of the Texas Legislature.
The Legislature’s intent in allowing university and college presidents to create “reasonable rules” regarding campus carry was to allow institutions of higher education the discretion to address, as the law puts it, “the uniqueness of the campus environment.”
Obvious examples of that uniqueness include chemical storage facilities, biocontainment labs, mental health clinics, and disciplinary hearings.
The reasonable rules clause was not intended as a license to revisit the Legislature’s prior decisions regarding whether concealed carry should be allowed in common, everyday locations such as restaurants, theaters, and museums.
Brian Bensimon, Southwest regional director for Students for Concealed Carry, commented, “The fact that colleges and universities continue to exploit the ambiguities of the state’s campus carry law demonstrates that the bill passed by the 2015 Texas Legislature left us a few yards short of the goal line. The question now is whether the 2017 Texas Legislature will step up and finish the job.”
