IMPEACHING OBAMA: CONGRESSMAN MAKES BIGGEST MOVE TO DATE

IMPEACHED? I’D MUCH PREFER ANOTHER REMEDY… 

BUT THAT’S ME…

Ok, I did a post like this on Impeachment back when the Senate was in the hands of Dingy Harry and the Democrats, but since the Senate has changed hands, and an Impeachment requires a 2/3 vote to send Obama packing, much has changed. Thankfully I don’t see “IMPEACH HIM” under every post on my Facebook page anymore, but I think is more a reflection of people having given up, rather than them actually understanding how Impeachment works. 

With the way foreign policy and national security have been shaping up lately, I’m not so sure that if the House filed Articles of Impeachment, that it wouldn’t be a REAL nail biter for Obama during the trial. Maybe I’m wrong, but I think based on the 100-0 VOTE IN THE SENATE TO IMPOSE “CRUSHING SANCTIONS” ON IRAN IF THEY DO NOT FINALIZE A DEAL BY THE END JUNE, could signify, notice I said COULD signify, a little more than just the symbolic vote most followers would say that was. Let’s face it, President Obama once again acted in DIRECT VIOLATION of Article II Section 2 of the Constitution with his precious Iranian deal, so the Senate didn’t have many options.

Short of the Senate actually growing a pair and stopping Obama on the front end of that transaction, the “CRUSHING SANCTIONS” vote was all the Senate had left. It was the best they could do to attempt to keep Obama in check, and save a little face. With that said, out of 44 Democrat Senators, I bet less than half actually MEAN their vote. Come the end of June, if Iran hasn’t finalized a deal, I bet they’ll play politics when their votes are more than just symbolic. The OTHER half of the Democrats is where the Republicans might be able to pick off 12 Democrats and finally send Obama packing. 

So, the purpose of this post is to explain how we send Obama packing by Impeachment, and in doing so, if you weren’t previously aware of why Obama was never Impeached for all his previous antics, this should help explain the REAL reason from a constitutional perspective. Prior to now, and even at this very moment under a Republican run Senate, no matter how many times We the People scream for Impeachment, the math is just not on our side. The current makeup of the Senate is 54 Republicans seats, 44 Democrat seats, and 2 Independent seats.  The Constitution reads as follows:

The Constitution, Article II, Section 4: 

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

The Constitution, Article I, Section 3: 

The Senate shall have the sole Power to try all Impeachments.  When sitting for that Purpose, they shall be on Oath or Affirmation.  When the President of the United States is tried, the Chief Justice shall preside:  And no Person shall be convicted without the Concurrence of two thirds of the Members present.

Judgment in Cases of Impeachments shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust, or Profit under the United States, but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment, and Punishmnet, according to Law.

To understand why Barrack Obama will never be Impeached, it is important to understand what Impeachment is. Think of Impeachment like a grand jury proceeding where an indictment for a crime is pursued. Article II of the United States Constitution (Section 4) states that “The President, Vice President, and all civil Officers of the United States shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other High Crimes and Misdemeanors.” The House of Representatives has the sole power of impeaching, while the United States Senate has the sole power to try all impeachments. The removal of impeached officials is automatic upon conviction in the Senate. 

First, Treason is defined under Article III of the United States Constitution (Section 3) as “Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.”

The charge of high crimes and misdemeanors covers “allegations of misconduct peculiar to officials, such as perjury of oath, abuse of authority, bribery, intimidation, misuse of assets, failure to supervise, dereliction of duty, conduct unbecoming, and refusal to obey a lawful order. Offenses by officials also include ordinary crimes, but perhaps with different standards of proof and punishment than for non-officials, on the grounds that more is expected of officials by their oaths of office.”

SO FAR SO GOOD, WE’VE GOT OBAMA RIGHT?

As I said above, The House of Representatives has the sole power of impeaching, while the United States Senate has the sole power to TRY all impeachments. In laymen terms, for the purposes of Barrack Obama, that means the GOP controlled House of Representatives has the sole power to Impeach President Obama. Remember what I said when I began, that Impeachment is analogous to a grand jury proceeding. It’s a charge so to speak. Let’s assume the GOP controlled House decides to use their sole power to impeach the President. ALL that means, is they are charging him with Treason, Bribery, or other High Crimes and Misdemeanors. Like any proceeding, just because he is “Charged,” does NOT mean he is convicted. All that means is a trial needs to take place.So, if a simple majority of those present and voting choose to impeach Barrack Obama, then managers (typically referred to as “House managers”, with a “lead House manager”) are selected to present the case to the Senate.

The Ipeachment trial itself takes place in the SENATE, which although under Republican control, doesn’t have anywhere near the 2/3 vote required to oust Obama. Democrats would need to cross the isle. Do I think that’s likely? NO.. Do I think that’s more likely NOW than at any point previous to now? YES! During a trial, Senators would take an oath or affirmation that they will perform their duties honestly and with due diligence in the matter regarding the trial of Barrack Obama. After hearing the charges, the Senators would deliberates in private. Conviction requires a two-thirds majority. Let me say that again. Conviction requires a TWO-THIRDS majority of the Senate. At least SOME Democrats would have to cross the party and vote their conscious. 

One “political factor” you can be sure would be on every Democrat Senator’s mind is the rapid pace at which Obama has accelerated entitlements to American Families under his Presidency. Democrats know that if Obama is allowed to finish out his second term, it is likely at the current pace for entitlements, that when Obama leaves office there could conceivably be more households WILL receive government checks than those that DO NOT. 

Once that threshold is crossed, America has been “Fundamentally Transformed,” and every Democratic Senator knows that for all intents and purposes, we will be a ONE-PARTY SYSTEM OF GOVERNMENT. Few, if any families will vote themselves out of “free government money,” effectively making the government a ONE-PARTY SYSTEM. I have been saying for two years that this is the single LAST chance EVER to elect a Republican President. After 2016, if Killary wins, I predict there will NEVER be another Republican President. How could there be? Am I to believe that families getting government money would vote themselves out of that money because it’s the right thing to do? 

PLEASE! GIVE ME A BREAK!

Forgive me if I don’t have that much faith in Americans these days. Knowing that their party is on the verge of being permanently entrenched in power as a direct result of Barrack Obama, any chance that a significant number of Democrat Senators MAY have crossed the isle on the issue of Impeachment goes right out the window I think. 

Now that you understand WHY there will NEVER be an impeachment charge brought against Obama UNLESS Mitch McConnell SOMEHOW gets commitment from enough Democratic Senators ahead of time. Otherwise it would be a PR disaster for the GOP. Where the country is today politically, is a direct result of Americans not having a clue how the Constitution works, what powers each branch has, and what is or is not legal. Instead, as professor Gruber told us in all those colorful videos he was caught on, Democrats pray on the “stupidity of the American voters” to get things done. Frankly, I have never heard a better explanation of how elections take place in this country than the one below. It’s beyond sad, but it’s true. Watch it, and then do you part to spread information to those who need it most. The future is in OUR hands. We get the government we deserve. If we do nothing, after the 2016 elections, America as we knew it will be GONE.

After 7 years of numerous high crimes and misdemeanors, a member of the U.S. House of Representatives finally just made a move that could set off impeachment proceedings against Barack Obama.

Rep. Ted Yoho, R-Fla., is preparing to introduce a resolution setting forth the House’s definition of “high crimes and misdemeanors,” drawing an unmistakable line in the sand that would directly challenge Obama’s actions.

This is the single most significant action taken by a Republican towards impeachment to date.

The resolution introduces 11 different specific actions that fit the Constitution’s standard of “high crimes and misdemeanors,” and several of them apply directly to Obama.

For example, the resolution lists “failing to take care that the laws be faithfully executed through signing statements or systematic policies of non-enforcement” and “substituting executive agreements for treaties” as two of eleven potential high crimes and misdemeanors the House would be declaring “impeachable,” according to Breitbart.

It further adds the use of military force without congressional authorization, the use of funds in defiance of congressional appropriations, and the defiance of congressional subpoenas during oversight investigations are all impeachable offenses.

SOUND FAMILIAR?

Obama’s refusal to enforce America’s immigration laws, his threat of bypassing Congress on Iran, his illegal war in Libya, and his consistent defiance of congressional investigations into executive branch scandals like the IRS, Fast and Furious, and Benghazi all fit squarely within Yoho’s 11 criteria for a “high crime.”

Yoho said that the most recurring argument against impeachment by experts was that Obama’s actions are similar to actions of previous presidents. This, he says, is why the resolution is a necessary first-step to impeachment. Once Congress has defined its criteria for “impeachable” offenses, the “Bush did it, too” argument is immediately destroyed.

This resolution was crafted with the assistance of legal experts like Fox News’ Judge Andrew Napolitano and civil liberties attorney Bruce Fein.

Yoho added that he expects that the resolution will cause a liberal “firestorm” and will draw the ire of the race baiters, who will inevitably claim that the only reason the GOP wants to impeach Obama is because he’s black.

But Yoho won’t back down, declaring, “This is strictly about the rule of law.”

He noted that executive amnesty was the final straw. It was a “blatant, in-your-face ‘I’m above the law and I’m going to do what I want. I’m a dictator, I’m a king’” act, Yoho said.

This brave congressman should be commended for his efforts to fulfill his oath to defend the Constitution. Now, his colleagues who claim to love liberty and represent the interests of Americans need to step up to the plate and give this effort their full support.
